By creating an account, accessing, or using BrandGrid, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
BrandGrid is a platform that helps you create, manage, and publish content for your brands across multiple social media channels. The Service includes AI-powered content generation, brand management, social media scheduling and publishing, video creation, and analytics tools.
To access certain features, you must create an account. You are responsible for:
- Maintaining the security and confidentiality of your account credentials.
- All activities that occur under your account.
- Providing accurate and complete information.
- Updating your information as necessary.
- Notifying us immediately of any unauthorized use of your account.
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Violate any laws in your jurisdiction.
- Infringe on intellectual property rights of others.
- Transmit malicious code, viruses, or harmful content.
- Attempt to gain unauthorized access to any part of the Service.
- Interfere with or disrupt the Service or servers.
- Use automated systems or bots to access the Service without authorization.
- Impersonate any person or entity or misrepresent your affiliation.
- Collect user data through automated means.
You retain ownership of content you create or upload to the Service. By using the Service, you grant us a license to use, store, process, and display your content solely to provide and improve the Service.
The Service, including its original content, features, and functionality, is owned by BrandGrid and protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our prior written consent.
The Service uses third-party AI providers (OpenAI, Google AI, Perplexity) to generate content. AI-generated content may not always be accurate, appropriate, or error-free. You are responsible for reviewing, editing, and approving all AI-generated content before publishing. We are not liable for any issues arising from AI-generated content.
The Service allows you to connect and publish to social media platforms including Instagram, Facebook, LinkedIn, and X (Twitter). By connecting your social media accounts:
- You grant us permission to access your account and publish content on your behalf.
- You agree to comply with each platform's terms of service and guidelines.
- You are solely responsible for the content published through the Service.
- We are not liable for any actions taken by social media platforms against your accounts.
The Service integrates with various third-party services including Supabase, AI providers, social media platforms, and cloud storage. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the privacy practices or content of third-party services.
If you subscribe to a paid plan, you agree to pay all fees associated with your subscription. Fees are charged in advance and are non-refundable except as required by law. We may change our pricing at any time, and such changes will be effective immediately for new subscriptions. Existing subscriptions will be notified of price changes in advance.
We reserve the right to suspend or terminate your account immediately at any time, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by contacting us. Upon termination, we will delete or anonymize your data in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BRANDGRID, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
You agree to indemnify, defend, and hold harmless BrandGrid and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or relating to your use of the Service, your content, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BrandGrid operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of said jurisdiction.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the modified Terms.
